What attitude would that be? The attitude that douchebaggery is a bad thing for a community? You'll be hard pressed to convince me that I'm wrong in that belief. You're welcome to try, though, should you see fit.
And take whatever solace you may in the knowledge that my fun isn't being impacted by griefers at all. I play solo exclusively because I find it far more enjoyable. As such, I'm not subject to said douchebaggery, myself. The fact that such a pathetic practice doesn't directly impact me, though, doesn't mean that it's any less pathetic or something I should condone.

Forcing/tricking others into PvP is part of the game?!
Forcing/tricking others to ruin their fun because you cant have fun otherwise is not related to the community?
You basically say "deal with it, it's fine because I gain through it".
That's now the first thing of this kind that I heard of in PoE this far, I have to admit that the devs are nuts in some ways, and they have the ultimate potential to ruin their own game with it, so what...
Again, this, PoE, is carebear-heaven, if you need real grief, play EVE, carebears! :p

I loved EvE - was the best space dock simulator I have ever played.
About this issue with the bandits. It does give you a warning when in a team about what happens when you choose. If, it were me, and I was playing PoE in a PuG I'd quit the team right there. But you have the choice, and I am sure some people are to trusting or naive to think that some totally anonymous person would find pleasure in causing them pain. However, I do not think it is GGG's requirement to rectify poor choices.
Just my opinion.

1. read the text
2. deal with the consequences
3. if you skipped (1) see (2)

It doesn't tell you "These 5 people are waiting on you to choose so they can instantly lock in a coordinated manner to delete your HC character."
This is literally the only thing this quest option will ever be used for. At least disable this BS on the HC ladder so that I can enjoy group play instead of being forced to solo a part of the game.

Even if the poor choice turns out to be their own?
I ask in all seriousness because, in general, mixing PvP elements into an otherwise PvE game generally has a bad design smell. In two major instances, this quest and one other we're not allowed to talk about except in one thread, GGG has done exactly that. Amazingly both things are the source of many complaints and much argument. Why am I not surprised?

Well as you said you can solo this part of the game. or form up with people you actually trust. And no the warning doesn't say that, but It says very clearly in the description of your choice that conflicting players will duel. Perhaps a blurb should be added "and death will remove you to default" but I thought it was implied with "duel".

It is not the fault of the player to want to punch in their answer to kill Oak and expect everyone else to considering that is what happens 99% of the time.
I am puzzled how this is not a failure of game design and should be rectified?

Okay they can make the warning say "attention: everyone can choose differently than you and attack should you decide against them."
Maybe they can make it less technical and add it into the lore somehow or as part of the bandit chat as well.

Or they could simply add a dialogue after the choice is made that says "Your party is split over the decision, fighting may break out at any moment among the party members. [Leave] or [Fight].

This solution still allows consensual PvP but makes it harder to gang bang the noob.

A bit extreme... just add a button declaring that one or more persons have voted against and possibly give the option to back out to prevent a HC death. If the death didn't remove the player from HC league, then the problem isn't really that big of an issue.
Really though changing this as early as possible would be wise. One could assume that more issues similar to OP's if not handled.
