GGG. About your spyware.

And that brings us back to reality. I want to play the game. I love it since the beginning of it. So I just want the ToS changed to clearly reflect this. Win - win. I am confident that it will happen.

Reality. Hard reality.

ToS has nothing to change "to reflect this", there is already a statement:
"you either don't use our services at all OR you take all the responsibility for your actions".

You can freely choose second and safely play the game (till you won't violate any other rule). That's the law for you.
And win-win. I see nothing bad in this.

Haruka is right btw, the ToS already contains what you are asking.

So logically a new one/update is not required.

Also, trust works in both ways. I don't know how you can think this is "just now" happening all of a sudden.

Just because it's the hot-topic at the moment doesn't mean anything.

You either enjoy the game and its development/developers and are willing to instal the game and agree to the ToS. Or you don't and you go install some other game from a company you do trust.

Because let's be honest here, it's not like GGG invented this and is the premier company to utilize this, pretty sure any other game connected to an online infra-structure utilizes tools like these to keep the playing field semi-legit.

Whether this spyware business is true or not... GGG won't be able to hide behind their TOS if they are actively scanning people's computers in violation of a nation's laws. (Subject to local laws. It may be perfectly kosher where you live.) That's not how TOS work in many jurisdictions. Within the service, this argument has weight. That would be the game, website, and the information collected therein. (But, again, subject to local laws.) Thinking a TOS allows GGG to do arbitrary actions on a PC (like scanning my massive porn collection, or someone's sensitive work documents) is naive and dangerous.

Any consequences against GGG would likely require banned/affected people to hire lawyers and make a lot of noise (since this is a small service relative to big players like Google or Facebook). Otherwise it's small potatoes in law enforcement's eyes, or so I'd imagine. On the flip side, those big internet players have large legal budgets and can afford to defend themselves in N countries, should the need arise.

i just message CS yesterday about this they said AHK is allowed as long as its only performing one action at a time and its not on any type of timer or auto script! in other words you have to manually hit the macro and not a script performing it for you!

and all these people with a problem with GGG doing something about the cheating asking for a new TOS and all that... every single one of you is basically saying ive been cheating and now i dont think its fair i can no longer cheat anymore QQ! and its pathetic!

Before you claim that by clicking accept on the TOS it's binding you might want to look at applicable court cases that say other wise.
Regardless of that I think it's a good idea to put in and update the spyware. Some people enjoy beating the system and it will provide others with good reading when they post about it.
So far I have enjoyed all the freaking out posts on other sites.

How would you know that "OMG spyware" appeared exactly in this "client.exe"?

The reason of this "panic" is that now there are really big number of people using hacks in PoE.
And they are simply frightened about possible ban.
Well, they deserve it.

GGG is using "light version" of monitoring.
I can name you couple of companies, whose "monitoring-ware" stuff is relatively heavy and takes about 100 Mb or RAM. That's what i call "an elephant in the bush"

You hit the nail on its head, bravo.

Its also funny how people think that A, the cheating is something new and that B, the GGG scanning thing is new. I know that when i install a game that it scans for stuff i run along with it and i know damn well that cheating starts as soon as a game gets to the public.
