I'm sorry. But you're donating, not purchasing.

When you file your taxes, unless you want to end up in a states prison I suggest you don't put GGG payments as "donations"

Because this is NOT a charity. And acting like it is, is a violation of state law. GGG is not exempted from yearly taxes as a business like non profit organizations are.

Grinding Gear games is a commercial business not a non profit charity. When you buy support packs you are paying for a product you are getting something in return.

This is NOT donations. Donations imply that you are giving X amount of money to GGG and you get nothing in return. Support packs come with lots of things.

To receive donations they have to be a charitable organisation which they are not
Not true at all. Anybody can donate to anybody. Charitiable organization has nothing to do with it. Unless homeless people with tin cups on street corners are charitable organizations now.

Nobody here donates money to GGG though. People buy support packs or POE points which is a product or currency.

There is nothing charitable about buying something from GGG. A support pack is marketing and nothing more, you are paying for a product.

The only way to donate to GGG is to send them money and ask for nothing in return

So what are we arguing about?
For example I bought $50 USD in POE points last year I bought it not to support GGG but to purchase their MTX which they sell.

I don't believe in Free games nothing is free, something has to be paid for one way or another. For me to get the full experience I need stash tabs, I need certain cosmetics unless I want to look like a clown.

In d3 spending $60 means all cosmetics are unlocked, you get the full game upfront when you spend money on D3. In POE you DO NOT get the full game unless you spend maybe $2000 US I am guessing is what all the MTX is worth.

Vanishing die, stash tabs are all unlocked in D3 you don't pay anything because you purchased the game upfront.

I plan on buying a supporter pack the only one thats value for money is apprentice support pack and I emailed GGG yesterday requesting to purchase it but they told me I am not allowed to. So what do I do? I purchase nothing until a future day when I see a support pack worth its asking price.

prophecy support pack is not worth anything to me, the armor is ugly. Atleast in apprentice support pack the Armor actually makes scion look feminine, in prophecy it makes her look like a guy, no thanks.

Well I am arguing that as soon as I pay for something which is clearly designed as game content I become a customer and have consumer protection laws. Whatever they want to call they product e.g. "supporter pack". I even provided evidence that freemium games are not exempt from this (consumer rights act 2015). Doesn't matter that other people play this game completly for free. My initial statement was that it is not that easy to just ban people and it might be advisable to look into it if you are from the EU.
Ggg have banned Diamond supporters before. Donating doesn't free you from the ToS. Game responsibly and you have little to worry about.
Sound the dread alarm, through the primal body! Sound the reveille, to be or not to be. Rise! Stay the grand finale! Stay the reading of our swan song and epilogue. One drive to stay alive! Elementary, muster every fiber. Mobilize! Stay alive!
ToS doesn't free you from REAL LAWS!
ToS/EULA mean jack shit if they violate any laws. See consumer laws. Why would people think those things are the be all and end all. If the ToS states samewhere that you have to give away your firstborn child would you still go through with it? lol

This is true in America for example the constitution trumps state laws so the EULA/TOS comes in last.

Notice how intel had to pay billions to AMD for their shady business practices or Valve was forced to offer refunds on steam if they wanted to do business in the EU. So much for no refund TOS

Does it even matter? Customer protections don't give you immunity do break establishment rules. Has anybody won a lawsuit against a casino that banned them? A paying casino customer that gets caught cheating doesn't get their money back. They don't have legal protection from getting banned from that casino even if they were paying customers.
