As far as I know, the image is not an in-game asset from either IP. That it is a render of a 3D asset isn't at issue at the moment. The provenance comes from the Fallout Wiki, first, and it doesn't reach into the "sold" in-game assets within PoE. ie: It's a wiki to wiki copy/paste job with someone learning Paintshop...


Nope, that is the same image that appears in the skill tree in PoE.

However, if it is not an in-game asset of FO3, the model itself might be under a restrictive license - should be OK then.

So, just to be clear -

You're saying that image we're discussing is "in-game" in Path of Exile? In electronic format/display?

Can you actually tell what the image is? Is it comprehensible and could you recognized it? (ie: It's not shrunk down to a tiny little thumbnail blur of green/black, right?)

If so... lolz.

Some "artist" who could have gone out and found any number of completely copyright free open-source images for a "zombie" or rendered one of their own in ten minutes just pried open GGG's game and shoved in the foundation for a legal case complete with damages.

NOT that I think Blizzard would pursue this with enthusiasm, though. I think a phone/skype call and some fingerwagging would get the point across... But, if this is endemic and Blizzard and others just decide to image-search POE assets? And if they find a bunch of infringements?

Those game optimizations and fixes are going to be a bit delayed.

Just go into the game, open the skill tree, search for "Righteous Army" and zoom all the way in.

Whether it constitutes an infringement remains to be seen.

Minor stuff like this is usually made out of love. They are easter eggs or homages to people/works of art that the creator loves and adores.

No, you really shouldn't lol. Well, grabbing popcorn is probably ok...but definitely don't wait around on that other part.

I mean, I'm sure there could be some random idiot still waiting for Trey Parker and Matt Stone to sue LucasArts for allowing devs to put "Kenny" in X-wing vs Tie Fighter. But it never happened, and it's not going to.

Pretty sure that this is literally no big deal, they'll change the art and it will be the end of it.

Don't forget that this company is owned by Tencent, and the Chinese do this all the time for their games, and no one can actually hold them legally responsible for such cases. Expect more of these "Easter eggs" in the future
