Whilst it may be a "scam" it is not a problem GGG should be forced to deal with, they don't have the money, time or staff.
And whilst you may attribute a real money value to in game currency(why would you unless you RMT or are considering the legality in real life terms and consequence) it is in no way actionable as you entered a gentleman's agreement, it's not enforceable by law and naming and shaming(defamation of character) is.

It is all part of the general game enviornemnt. GGG values game knowledge and self sufficiency. Wraeclast is a lawless place, anything goes, the strong eat the weak. It is deliberately built in to the game with the bandit quest. If you interact with another player and are weaker or less knowledgable you can easily come out of it worse off. Don't want to get scammed? Do your research and kill your own bosses. Personally, I like it.

I've often thought about to trying to hunt down the pricks that do the bandit pk thing but don't the really play HC and suspect it would end with me dead and pissed. Hunter that gets eaten by the lion. Hah.

lol dude, you can't turn items into money without breaking the terms of service and maybe some laws as well, you can't argue that "oh but i can sell this on the black market"

this is a game, it's not real life, stealing and tricking people in a game doesn't mean anything, what kind of fucked up society would punish people over something like this someone call george orwell

Not sure what laws it would break. TOS is more to protect GGG from legal repercussion than the players.

I've tried as well, never had any luck. PKK was my favorite part of d2.

they have a system in game that makes scams impossible unless you highlight over the item and explicitly agree to give it to someone else, accepting the trade is extinguishing your rights of ownership over the item

well all the items and characters and everything belong to ggg, they can delete you if they feel like it which means they own them, if you are selling items for real money it's like selling someone else' property, the only difference being they themselves support the idea that these items have no value because they ban selling them, so they can't say you caused direct material damage to them

the only things that you could say they belong to you are the microtransactions you buy with real money

i don't know if this would hold in a court of law but it's an argument
