If balance was not at stake then TFT would not matter. For instance, if your character was as powerful with or without TFT, then no one would be annoyed by it. That would make TFT completely voluntary.
TFT causes problems because it increases power vs time a lot, thereby 'forcing' you to use it if you want to be competitive.
(Force in quotes because its more a matter of time spent than it is impossible to progress without it, but the time difference is significant.)
Second problem - the endgame designers have to account for the power of items made possible by TFT, for example combining hundreds of players worth of harvest crafts. They then 'have' to nerf harvest because of a tiny group of players breaking the intended function - which clearly did not include being able to easily trade crafts or they would have made it a tradeable craft item.
Harvest, an important part of the balance equation, was directly nerfed due to TFT (per Chris).
Anything that has that level of power influence, but is handled by some third party with no responsibility to anyone at GGG is problematic.
That is why TFT and balance are related questions.
If TFT was problematic enough couldn't GGG just throw a cease-and-desist order at them.

There are no laws saying 3rd party websites can't break game balance or even break a game.
They 'technically' arent trading GGG material for real money, although everyone knows that the mirror service provided by TFT mods is insanely profitable. They also ban their own competition, as shown several times on reddit.
Now whether they turn those mirrors into real $$ or keep the profit in the game, who knows.
They could potentially be served if you could prove via IP that they are using TFT to making tons of currency, then selling currency, but that would be hard, and they could just use different accounts.
I do not condone RMT and this post is not promoting it mods. RMT is bad. I am not accusing TFT of RMT, just saying that if they were that would be the link necessary for a cease and desist order.

Actually you are quite wrong unless it's signficantly different in a bad way in NZ. You can issue a cease order for the following reasons.
Bullying
Stalking
Cyberstalking
Intimidation
Invasion of privacy
Breach of contract
Libel or slander
Trademark or copyright infringement
Property boundary encroachment
They could go after them for Breach of Contract as the terms of service is a contract, and what they are doing can easily be found in the vagueness of the terms.

The legal side of things is less likely the reason they didn't do so. Going after fans is tricky. It can often backfire so you need to be sure they are costing you more revenue then you would lose from the backlash.
It's why Blizzard Opted to work with a private server to bring Classic WoW into being.
