I asked the support about a known scammer and they told me that his account is marked and if he keeps scamming punishment may follow.

Normal support response to satisfy the one contacting them as per usual (not speaking about PoE only).

They told me the same thing and obviously they didn't do anything. It seem to be a "pre-made" answer just to make us stop complaining

Scamming is allowed.

Calling out scammers isn't allowed.

You either spoke to a new guy (they've had lots of new support staff come on over time) or you got mixed up between "scamming ingame" and real world / real money scams. There are posts from Support/Devs that make this point black & white. I can't be bothered looking 'em up but I paraphrase them as: "no one will be banned for exploiting the stupidity of other players".
