Is it illegal/bannable to "scam" someone in game?

So I've seen a couple people in trade chat trying to sell items for obviously good deals.

I was trading one guy for a 6L glorious plate for 5 exalted (obviously too good to be true, but you have to try?)

He asks me if I can swap out an exalt for 5 gcps, so I cancel trade and grab 5 gcps. I then notice that he is trying to trade me a 4L glorious plate instead of a 6L (obviously).

While I wasn't the victim of something like this, I remember people in Diablo 2 and Diablo 3 getting away with these without any consequences because it was the buyers fault for not noticing.

This all stated, is it illegal to do this in PoE? It would be nice to get rid of people like this because its obviously going to have a negative effect on people that aren't aware, or too eager and trade without checking.

Just incase people are wondering who to watch out for, his IGN is _RealDeal (ironically)

i saw that ass jumping chat channels earlier trying to pull that scam and he should be banned immeadiately GGG should not condone or enable scamming and the whole name and shame thing needs to take a fucking hike. actions such as this player keeps trying to pull is only bad for the community and game as a whole. Assholes like this didnt exist in closed beta.
whenever someone tries this, I just take back my offer also and replace it with 1 Wisdom Scroll...it is a nice touch.

You need to think about the outcome of what you are suggesting and what it can/will turn into.

Allowing name and shame can easily be abused by anybody to make up fake story, ruining good peoples reputation. And yes, it would be abused.

Same with an option to report and repeating offender banned, will be easily abused with multiple account/friend deciding they don't like one person.

Mods are busy enough already without having to monitor trades, and most likely don't have access to all the information necessary (trade windows log, whispers etc) to make an appropriate call.

Dev sure have much better things to do then monitor logs, check if your story holds and the ban/mute is appropriate, this isn't just a line of text, its tons of information that needs to be looked at to make sure the good call is made.

It's not as easy as receiving a message saying "Hey this guy tried to scam me by switching a 6l to a 4l" and then they ban, they'd have to make sure the guy advertised the 6l, then he showed you the 6l, then he told you whatever to cancel (but not telling you he was switching to a 4l), then trading you the 4l for the same price, all the while not indicating to you the switch.

And no a 4l not being worth 6 exalt is not a valid reason to ban. Who's to say its not anyway.

The tools are there to not be scammed in the first place, so if you somehow accepted to trade 6 exalt for a 4L, well its your own fault for clicking the OK button.

Edit: I'm sure in a world where any of the above option couldn't not be abused, GGG would be happy to provide it, but that just not the case, and its not as simple as coding for 1 hour or hiring 1 more guy.

My understanding is, no its not.

It is 100% legal.
Even though GGG won't state things like this, they will imply it by saying their trade system is good enough, they won't do anything and its between the players, and so on. Oh, they also mentioned that they try to make POE's in-game life more realistic such that everyone is an exile so they don't trust each other. In such case, scamming becomes reasonable. I am sure one of the dev/staff mentioned that they purposely will only have FFA looting system because they want to create a sense that your teammate, another exile, may steal your drop, making it realistic.

Basically how it is.^
Scamming is funny. I never do it but always find the little tricks amusing. It only annoys me for about 1second when I thought I was making a deal but in the end just wasted my time.
is there a way to check item level while trading? Before the trade? ... I forget.

Hold down alt while hovering the item in the trade window.

If they wanted scamming they wouldn't develop a fair trade window.

If they didn't want it, they could make that clear in their TOS, and would do something such as put users on probation who do this. Notably, they haven't done the first, and to my knowledge have never done the latter.

I think we're just going to have to get past it. It's easy enough to avoid.

No, it's totally allowed. It's a game. Your choice to accept a sale or not.

caveat emptor.

I asked the support about a known scammer and they told me that his account is marked and if he keeps scamming punishment may follow.
