Account Banned for being Disabled?

Yes, cheat detection usually only sees signatures, stuff that isn't supposed to happen. It simply does react to those things then. Also even if you're using such a program it's hard to discern if it's using the right program or some other source.

I personally guess GGG's anti-cheat is situated at the server-side only to check the data-transfer. To handle discerning different programs via a whitelist it needs to be implemented into the client as well and check steadily if the client has been modified to give a 'hoax' signal as well to make sure it's not white-listing the wrong stuff. That's a bit more complex.

Also, talking about the situation if anyone who is disabled would have some sort of advantage.
That's... besides the point. It's extremely unlikely, doesn't change the fact that the needed system to even allow exceptions of the ToS in such a case can be exploited fairly easily. At least compared to before.

-There is most likely no framework present to discern between a 'legit' user of a program and someone who uses the same type to gain an advantage.
-If GGG implements something client-side it's a security-hole which can be abused, the question there is then 'worth it?'

As for 'but it's good PR'. GGG has a firm grasp as the top developer in the ARPG-Multiplayer scene. Literally because they are the only half-way decent once existing which even has a half-way decent amount of content in their game.
GGG is the equivalent of Coca-Cola, they don't need ADs anymore besides 'special' situations, everyone knows them.
Also, what would the PR relate into? Maybe 100-200 people coming? (With the disabled included). What would be the cost on the other hand? 50-100k? Around that amount? Probably even more depending how in-depth changes have to be? Just not a good outcome overall.
GGG balance is like getting a pizza which is burnt on the sides, raw in the middle and misses the most of the toppings.
Then upon sending it back you get a raw side, burnt middle and enough toppings to drench everything in grease.
Everything fixed but still broken.

It's the same as complaining about going to an opera as a deaf person and not having someone there to do sign-language for everything presented. It's just not feasable and the number of people affected is just too small of a sample size.
I know, it sucks, but it would cost money better spend elsewhere... like fixing the game-mechanics and missing QoL features, as well as optimizing the game finally again.

not really, it's more like a deaf person going to the opera with their own signer and finding a sign on the door ready "no-sign language", then having the other patrons claim the moral high ground (there's a sign, so bugger off deafy!) when the deaf person with signer enters anyway.

Yes the guy should have thoroughly read the ToS and contacted GGG beforehand (just like I bet all of you guys did, 5 years ago whilst signing up to this small, free indie game you had no idea would have legs...) but there is room here for reasonable people to work out a compromise.
not really, it's more like a future space ninja arrives looking for john connor's grandma's neighbor's dog because it really needs some bellyrubs.

and then mars attacks. and then i wake up and post here.

it's more like that.

I live in Canada, I'm sure many are aware that marijuana was recently legalized across the country.

When that happened they also enacted multiple laws regarding being under the influence while driving, you can be fined, lose your license, etc.

On the same note many people have medical licences to smoke marijuana, while many people who use the drug on a daily basis for improved quality of life never bothered getting a license because they didn't see the need.

1000's of people have been fined to date for being under the influence while driving, while majority of those people claim that they need the drug to maintain a healthy standard of living.

These people did not win in a court of law, however you expect ggg support staff to make an exception for you being disabled when you refused to say anything prior to the fact, and claim it is not fair after being banned.

Welcome to the real world.

That being said, if you do wish to continue playing the game I wish you all the best in finding a way to enjoy it that stays within the terms of use. Whether that be pleading to GGG the TOU is amended for someone in your situation, or simply finding an alternative. It is a terrible precedent to reverse the ban due to the fact you waited until after the fact to request special treatment, because of this I don't think you deserve to be unbanned. You basically knew you were breaking the rules and were counting on this being a valid excuse the entire time if you were to get caught. Sorry not sorry.

if "i needed those cheats because of my disability" was a valid excuse for cheating then every single cheater on the internet would instantly claim disabled status whenever he gets banned from some game.

for example, i'm 100% sure that you are not the first person to get banned for using a flask bot that automatically drinks a life flask when your health drops. plenty of people tried that before, and they got banned for it too.
now if GGG unbanned you, what would stop all these others from also writing posts about how they are disabled and need the flaskbot to play the game? GGG would then have to unban every single one of them.
