Stop trying to sweep it under the rug.

The appropriate punishment for fraud — not merely "ripping people off," but actually flat-out lying to them in order to acquire their in-game wealth — should range from probation to a permanent ban. Usually a permanent ban; the probation option should only be used in circumstances where the accused can make a solid case that he himself was lied to somehow, such as getting a trade advantage by saying "they are going to remove Righteous Fire in the next patch." Naturally, multiple offenses of the "lesser fraud" should result in a ban.

I am curious about the name-and-shame policy. Is this something that GGG does because they believe that it's right in-and-of-itself, or is it more of a legal thing, where since you are hosting particular content on your property you open yourselves up to some kind of liability (slander suits, etc)?

Because if it's about limiting your liability in an overly litigious world, I totally back you up. Seriously. I don't believe you should risk your own tails just to try to preserve "free speech," because it's not really free speech, it's free speech on your property with your implied consent.

But if you're locking these threads just "because," well, I have to say I disagree with GGG there. If the decision to limit what is said on these forums is not made because you have a lawsuit gun to your heads, then I feel we deserve a detailed explanation from GGG on why they believe so strongly in the name-and-shame policy.

My previous comments were deleted because they were in a completely deleted thread (didn't see that coming). So here they are again.

1) ARPGFAN was obviously either going to sell the chest or was considering selling the chest. So he lied in his latest begging thread and is stretching the truth to people in calling it a price check.

2) If I was him I would admit that I screwed up (apologize to everyone) especially those who donated fusings.

When I saw his original thread I thought to myself that people decided to help him out because they like his passion for the game and they truly believed that he would keep the chest forever. I think the wealth of the item went to his head and he decided that he would rather have that than the chest itself. What he needs to understand is that people never would have contributed the fusings if it was just to further his wealth.

All that being said people need to get over it and move on. Let him know you don't like him anymore if you absolutely have to but he really didn't scam anyone or anything like that. People made the mistake of giving away free currecy( or didn't if they don't care). Thats on them, when you give someone something then they now have the ability to do whatever they want with it. It might be deceitful of them to lie about what they were going to do with it but you took that risk and thats something you should own.

I know a case in german law where a company was accused of scamming in real life. This was done in a forum and the company sued the forum user. The court though argumented that in this case it was freedom of opinion and don´t fullfilled the fact of an insult or calumny. Another explenation was " ... that in a openly puplic discusion ... critic (must) be accepted even in form of hyperboles or polemic because otherwise it would paralyse or narrow the process of opinion making."

As far as you´re concerned about rights in a forum. In my land the forum owner is constrained to remove unappriacte content like child porn, racist or heavily insults and such. He can even charge those person. Some other laws are though not his concern. He´s not forced to freedom of speech or census. He can even pre-census or ban people "just because". It´s his houseright.

edit: another thing to name-and-shame. I doubt there is any law that protect digital people/avatars. I know for example gaming sites where name-and-shame is wished and supported by the whole community and even the forum owners without any problem.

In a completely hypothetical situation like the one we are currently discussing, I was starting to lean towards your point of view as far as letting it go, but a comment like that would just completely reinforce everything I had previously felt.
