Even if you assume Blizzard is making money because people are buying copies of Diablo 2, Blizzard is legally in the clear, they made Diablo 2, and what people did with it after that isn't their problem. the name Path of Diablo is also legally fine, Path of X isn't owned by GGG or anyone else. Also as long as the creators are not profiting from it, modding games is totally legal and fine.

If it were against any copyrights or terms of service, twitch would have pulled down the streams within 48 hours. This isn't 2014 where online game streaming was budding industry. These guys know that unlicensed games could instantly destroy their business model.
Most streamers are even reluctant to mention the word "Torrent" as most of the time that is seen as pirating/black market kind of stuff (even though it has legitimate file sharing uses other than that).

Hahahaha! I love it when someone makes an ignorant comment accusing others of being ignorant. Blizzard sued someone for making a version of WoW available on a private server for free. My point is, just because someone provides something for free that uses a trademark and other forms of intellectual property from another game, doesn't make it alright. It's still theft of intellectual property.

Lol. Fireballs have been in all fantasy concepts forever. No copyright can still be claimed on Fireball unless it's designed in exactly the same way as another game. The Fireball in PoE and Diablo 2 are totally different. A skill like Cyclone is not the same as a skill with the name 'Cyclone' but if it is used, they should be able to prove that it's not based on PoE. The thing is, everything in PoD is based on PoE (which is not a secret) and Vaal Orbs are definitely original to PoE so would definitely be protected.

How would I get banned? I played D2 exclusively offline and solo. You know, for fun and not as a job :)

Whoever made the PoD mod obviously played PoE first so agreed to this term before installing it. This person totally violated this agreement.

Being inspired by something, is totally legal. An illegal copy would be taking the artwork, the code and releasing it as your own.
If we look at POE then we see a lot of stuff that looks and sounds familiar to the Diablo franchise. It starts with the UI and completely covers the spells. We do have skeletons, golems, fireball spells, the flasks visible in the UI, the two globes that hold mana and life ...
If GGG would had copied the code from Blizzard and then just tweaked a few things here and there, while releasing it as their game and not a fan mod, then we had a case.
But so there is none, just like there is none for the creator of said Diablo mod.
Btw. if someone plays a game is irrelevant. You can could have never played POE, but if you copy it´s context and claim it to be your own, then you would still have a copyright infringement on your butt.
People need to learn that reading and agreeing to a law, is not necessary for breaking it. I bet there is a lot of law that you never heard of :)
