There are currently 21-24 passive points available through quests, which means 7 (or 8 with bandits) available in each difficulty. When the game gets taken down to 2 difficulties, the quickest solution for passives if they want to keep parity with the current setup would be to have 11 passive points per difficulty which puts us at 22 points baseline, and then the Bandits can be done twice for +2, totaling 24 points.

That's the expectation I have.
So is act 1 difficulty 2 going to be harder than act 5 difficulty 1?

Go play Diablo 3. You can get carried to 70 in about 5 minutes.
