Merciless mod is the same "once in a blue moon" drop like 6L or tier 1 gear. We just had a Blue Moon July 31st and the next one isn't until January 31, 2018 so I'd surmise that it's a way too rare drop event.
But this is typical of GGG thinking. Make a great game feature or item (divination cards for example), lock it up tight by gating it behind super low RNG drop chance, and slap the label "hardcore" on their game. Make all players farm for 1000s of hours and proclaim PoE is a hardcore arpg. PoE is not hardcore, just extremely hard time consuming. That's all it is. "You've got to grind, grind, grind at that grindstone..."
