And who has no mark?

Why in the f would this be the player, it doesn't even make sense literally. If you had a mark you would be marked.

If this is intended behaviour the correct wording would be "and you have not applied a Mark" or "and no Mark has been applied" (recently? ever?)

The behaviour of Mark on Hit is rather with respect to the monster, so this ought to be consistent.

The last description line on mark skill gems reads "You can only have one Mark at a time." The modifier line on Oskarm is consistant with this: if an enemy is Marked by you, then you have a Mark. Marking a different enemy would remove your previous Mark.

It's probably designed this way because it has a lower cooldown, and most people wouldn't want to spend mana recasting this mark twice a second.
