How does PoE not end up in a lawsuit?

Right. Many of these similarities have been key components of the rpg genre for decades, well before modern computers even existed. You'll notice that many of the skills and spells in a game like D2 are taken directly out of the D&D Player's Manual (D&D and the D20 system are currently owned by Wizards of the Coast).

You'll notice for example that names have been changed slightly where the similarities come a little too close (incidentally that's all you really need to do to avoid legal liability). Frost Nova is now Ice Nova, Corpse Explosion is now Detonate Dead, Scrolls of Identity are now Scrolls of Wisdom, . . .

Just because D2 had a certain atmosphere doesn't mean that Blizzard owns that atmosphere. If that were truly possible then they would all just owe royalties to Edgar Allan Poe and JRR Tolkien.

Blizzard would also owe royalties to Rogue for all the similarities between it and Diablo 1.
Baulder's Gate and PoE play the same, I love the Genre.

Please don´t compare Baldurs Gate to path of Exile - its like comparing apples and nuts...
I understand where he's coming from, PoE's dark atmosphere and toned-down color palette really makes it feel like Diablo 2's spiritual successor. Diablo 3 has been embellished with World of Warcraft's bright color palette and cartoon art, so it doesn't feel at all like the Diablo 2 we've been playing for 11 years.

Aside from that, PoE has enough going for it to make it a stand out in the A-RPG genre, so no lawsuits here.
Ive played diablo 2 for years on end... and i see barely any visual resemblance.. Wow its dark... and diablo 2 is dark.. and thats about it

Because copyright laws do not work like that. I don't see it as GGG ripping off Blizzard and neither would a judge. GGG made something very similar to the Diablo game franchise, but it is not a duplicate. It doesn't use the same engine, code, gameplay mechanics and so forth as the Diablo games; all of the specifics are quite different. The concepts themselves are not copyrightable since placing ownership on ideas would make for a very oppressive society.

Short of the long of it is: GGG didn't steal anything and they're not wrongfully profiting from any other person's work. Even the idea of Blizzard suing them is kinda stupid. They put their own blood and sweat into this game.
Maby im wrong, But dident hellgate:london get sued by blizzard, Or was the becuase of bugs? (Lots of rumor's about the original company)
