I'd prefer they went with the character as punishment for death it is hardcore afterall. If all items stayed in the hardcore league it would get flooded.

That will be hard punishment, you will be starting from scratch.
If looting will be allowed I don't see risk with 'flooding' HC with items, sometimes all party gets wiped and there's no one left to pick stuff up/char getting killed in such situation that other can't get to his remains.
There will be always a bit situations like this and pretty significant amount of items will be lost (sinked) that way.
Last but not least sometimes ppl get out their minds, go solo and get killed :D

Keeping items in stash on HC when inventory will go to SC i also pretty weird. It should work the other way around imo.
Stash goes to SC, inventory is free to be looted by mates.
