Garb of the ephemeral not working on merc

As tittle says.

My merc is using garb of the ephemeral, I am getting slowed by chill, she gets locked by stone statues all the time, grasping vines lock us down.

I have tested this in several maps, and its not consistent. From time to time garb works as intenteded and the difference is significant.
