Mercenaries don't appear to level downscale in group

I'm level 43 with a level 40 mercenary. When I play with my level 10 friend, WITH level scaling on, I am downscaled to level 10 but my merc appears to keep doing damage as if it stayed level 40. Basically it's one-shotting everything where it should be hitting much weaker hits.
