Smite - Mark on Hit

When using smite and having mark on hit w/ snipers mark

The mark on hit support only works on rare or unique enemies. Is it failing to apply the mark when you hit on of those?

After more testing
I found out if I have TEMPEST SHIELD on, MARK ON HIT does NOT work |
