gems are capped at level 40 now

This is so not a balancing issue. You're way over the top before you get to 40. This is just so that they don't have to code stuff for people at that end of the bell curve.

ok, maybe "damage control" is the better word.

still, introduction of hard caps means the end of an area of happy exploitation which devs are unaware of. also, sources of +level to gems is a rather simple field. if you need hard caps to control it, what's with more complicated stuff?

the way i see it, if gems at level 40 do exist, sooner or later there will be content which requires such a level, a moving bell curve so to speak.

Nah... the ol' slippery slope argument doesn't always come to fruition. There is still a vast majority of players who simply don't push extremes just to see how far they can push them. They don't balance the game based on these extremes.
