Avian's Might + Phasing bug i think

I have these gloves, and a Watcher's Eye prismatic jewel with phasing while affected by haste. Normally with that jewel i should have phasing all the time i think. Aspect of the avian grants 2 alternatig buffs , 4.96 seconds each. The problem is phasing is only active half the time, instead of all the time. It is only active during avian's flight, and gets disabled during avian's might even if i dont't attack or cast anything.
