Withertouch Merc taking kill credit even when doing no damage

Hi! This is pretty niche but I've found out that the Withertouch merc takes all kill credit when they Bane the enemies. This is particularly annoying as I am using Bino's so the poison prolif does not work as the game thinks that the Merc is actually killing and not me.

I confirmed this by using the Wreath of Phrecia helmet, which means she does no chaos damage, and Victarios Acuity so she get Frenzy/Power charges on kill. But since they do no damage they should be getting no kills and no charges, but they still get them.
