Careful Conservationist notable flask charges gained if you've dealt a crit recently doesn't work

The 20% flask charges gained if crit recently doesn't seem to apply at all. Tested using "gain 7 charges gained when hit by an enemy". with 70% and a crit recently to bring it up to 90% I would get less then 13 charges back. With 20% extra from a cluster jewel taking me to 90% and no crit recently I would get 13 charges when hit. Meaning the part from Careful conservationist never applies. It also doesn't affect the flask charges gained modifier in the character misc screen.
