Not getting a passive point at level 2

I was experimenting with a HC marauder and I found that when I reach level 1 I get 1 passive skill point. If I hold on to it and don't use it and then reach level 2 I still only have 1 passive skill point. If I hold it and then get to level 3 I have 2 passive points. I did one more level to see if it was incrementing properly and at level 4 I have 3 passive skill points. I then deleted my marauder and tried it 2 times more with the same results. Always at level 2 if I haven't used my first passive skill point I don't get a 2nd point. I think this is a bug.

you start at level one don't you?
so by level 4 you will have leveled 3 time and have 3 points Ancestral Bond. It's a thing that does stuff. -Vipermagi

Hmmm .... I'll have to rerun this but ... maybe I'm not awake yet and will eventually have a DOH! moment and then feel stupid.
