Windows 10 (solved)

Issue is resolved, however unclear on which step it took, so I'll list them all:

Run as admin (likely has no effect alone)

Forced my monitor to be recognized by windows 10 (with .inf file) This is most likely what was causing the issue was not knowing what "display" was attached, windows recongnized a generic PnP monitor before I forced the driver.

Rebooted the machine

Just downloaded windows 10 technical preview so I can test compatibilities for games and having an issue with PoE.

Error in case that image goes down is:

The D3D device has a none-zero reference count, meaning some objects were not released.

System\Dxdiag information here.

The error message occurs when I launch the game, I never was able to load in and change the settings. I understand that the settings are in:

C:\Users\USERNAMEHERE\Documents\My Games\Path of Exile

I changed various settings from other threads with similar error, but I feel my issue is specific to Windows 10, not my video card (cause this worked before on windows 7)

Windows tells me I have the newest graphic drivers for my PC, so I don't think its that.

Any help on what direction to go here would be appreciated. I'll keep trying things and let people know if I find a trick to get windows 10 working.

No issue on my end with Win 10 preview..
I have a Windows 10 and have same problem with D3D... I cant run with other settings in cofnig in my documents too. I have nvidia geforce 560 TI, before on Win 7 worked ;/. Can anyone help me?
If you want windows 10 to work with poe you have to make sure to instal the windows 10 support driver offered in the Nvidia control panel. Without the support driver the game wont run.
