Passive tree in occultist and jewels

to be clearer, it's my level 95 occultist, I can't refund, remove the jewels (they stay off but still giving the passive bonus and leaving 14 passive points to allocate again) and not to mention, my caustic Arrow which is using health and mana at the same time instead of just mana.
